Justice served at Barksdale

The military justice system is a commander's tool to ensure good order and discipline and mission accomplishment. The ultimate forum for military justice is a court-martial. A court-martial can sentence punishment of reprimand, forfeiture of pay and allowances, fine, reduction in grade, hard labor without confinement, confinement, punitive separation and death. Courts-martial are open to the public and military members are encouraged to attend to develop their understanding of the military justice system. A lower-level adverse action is nonjudicial punishment pursuant to Article 15, Uniform Code of Military Justice. A commander can impose nonjudicial punishment of correctional custody, forfeiture of pay, reduction in grade, extra duties and restriction. Involuntary separation, or discharge, is not a punishment but an administrative means for the Air Force to achieve authorized force levels. Separating Airmen who fail to meet standards of performance, conduct, or discipline promotes readiness and strengthens standards of military service. The following Airmen were court martialed, received nonjudicial punishment or were discharged in February/March 2010:

Nonjudicial Punishment

2d Logistics Readiness Squadron
A senior airman was charged with an Article 86 for absenting himself from his place of duty. Punishment was 30 days extra duty, suspended reduction to E-3 and suspended forfeiture of $200 for two months.

A technical sergeant was charged with an Article 128 for unlawfully striking his wife. Punishment was reduction to E-5 and suspended forfeiture of $1,462 for two months.

2d Aircraft Maintenance Squadron
A staff sergeant was charged with Article 92 for failure to follow a technical order. Punishment was 45 days extra duty, suspended reduction to E-4, forfeiture of $300 for two months and a reprimand.

A senior airman was charged with an Article 111 for physically controlling a vehicle with an alcohol concentration above the legal limit. In addition, the senior airman was involved in an accident and left the scene without making his identity known. Punishment was 45 days extra duty, reduction to E-2 and a suspended forfeiture of $250 for 2 months.

An airman first class was charged with an Article 134 for unlawfully entering the dorm room of another Airman. Punishment was 7 days extra duty and forfeiture of $250 for two months.

2d Maintenance Operation Squadron
A senior airman was charged with an Article 92 for violating a no contact order issued by his commander. Punishment was reduction to E-2.

2d Bomb Wing Staff
A technical sergeant was charged with an Article 89 for disrespecting a superior commissioned officer. Punishment was suspended reduction to E-5, reprimand and forfeiture of $500 for two months.

2d Munitions Squadron
A senior airman was charged with an Article 134 for being incapacitated for the proper performance of his duties. Punishment was 21 days extra duty and forfeiture of $200 for two months.

Courts-martial
An airman first class was convicted by a general court martial for two specifications of wrongfully and knowingly possessing visual depictions of a minor engaging in sexually explicit conduct, in violation of Article 134, UCMJ. The airman was sentenced to forfeiture of all pay and allowances, reduction to E-1, confinement for 24 months and a bad conduct discharge.

An airman first class was convicted by a general court martial for one specification of failing to go to his appointed place of duty, in violation of Article 86, UCMJ. In addition, he was convicted of one specification of making a false official statement, in violation of Article 107, UCMJ. The airman was sentenced to a bad conduct discharge, reduction to the grade of E-1, forfeiture of all pay and allowances and 14 months confinement.

Discharges
Five members were discharged in March 2010. Two were discharged for minor disciplinary infractions. The remaining three members were discharged for various reasons including mental disorder, drug abuse and commission of a serious offense.
