Military Informal Complaint Process
The informal complaint process is available as an alternative to filing a formal complaint. This process empowers the individual to decide on the best way or most appropriate means to address and resolve their concerns.
Military Formal Complaint Process
When individuals believe their concerns about unlawful discrimination or sexual harassment can only be addressed through a formal process or they are not satisfied with the informal process, the EO formal complaint is the next option.
Time Line:
Individuals should submit formal allegations/unlawful discrimination or sexual harassment no later than 60 days after the alleged
offense. If the 60-day window has passed, the complainant must provide sufficient justification or extenuating circumstances to the EO office for review and subsequent approval by theInstallation Commander.
Civilian Informal Complaint Process
Aggrieved persons who believe they have been discriminated against on the basis of the EO protected categories, must consult an EO counselor prior to filing a complaint in order to try to informally resolve the matter.
Time Line:
Individuals must contact the EO office within 45 calendar days of the alleged discriminatory offense.
Alternative Dispute Resolution
is a voluntary option offered to everyone. Its process involves mediation, facilitation, structured negotiation, or other roblem solving techniques, or any combination thereof, which often produces more efficient and effective outcomes.
Civilian Formal Complaint Process
When there is no resolution at the informal stage the aggrieved person can file a formal complaint. This must be done in writing within 15 days of receipt of the Notice of Final Interview from the informal complaint process.
